On June 30, the New York State Court of Appeals upheld a lower court ruling that allows towns to use zoning ordinances to ban hydraulic fracturing, the controversial natural gas extraction technique known as fracking. While the state has had a moratorium on fracking in place for six years as the Health Department studies the potential health effects, some towns have taken action to ban fracking in anticipation that the state will soon lift the moratorium.
