Laura, Colin and Alex Rideout face sentencing later this month after being found guilty on charges related to the death of Craig Rideout.
Craig's estranged wife Laura and son Colin were convicted of murder in case. Alex Rideout was found guilty of tampering charges. Craig Rideout's body was found in a wooded area in Yates County last summer. Deputies said he has been beaten and strangled.
In new motions, the lawyer for Laura Rideout wants her verdict thrown out because Judge Tom Moran tried all the defendants together. "I think ultimately it would have been more fair for Laura to have a separate trial from her co-defendants," attorney David Pilato says.
In his motion, Colin Rideout's lawyer says there should have been severance -- that means a separate trial for Colin.
News10NBC: "Do you think that if there had been separate trials the outcome for Colin Rideout would have been different?"
Matt Parrinello, Colin Rideout's attorney: "I don't know. That's a good question. I don't know."
For Alex Rideout, it comes down to proof. Remember, he was found at Devil's Bathtub in Mendon Ponds Park with a car full of garbage bags of bloody clothes and other evidence. His motion to throw out the conviction says, "There was no evidence that Alex was aware of the presence of the bags in the trunk or their contents."
"The impetus for doing this is again, to ensure that everything that can be done for the client is done for the client," adds Julie Cianca, Alex Rideout's attorney.
But, these motions, known as 330 motions, ask the judge to overrule him or herself -- a tough thing to get.
News10NBC:"Have you ever won this kind of motion?"
Julie Cianca: "No."
Pilato and Parrinello says the same thing: They've never won a 330 motion either.
