Marion man faces charges after argument allegedly turns physical

A Marion man faces charges following a domestic dispute last week in which he allegedly tried to strangle his former girlfriend as she clutched a child.

Sergio Cruz, 34, of Joy Avenue, was charged with petit larceny and criminal obstruction of breathing in connection with the alleged dispute. Cruz was released on his own recognizance pending a court appearance.

According to the Wayne County Sheriff's Office, Cruz and his ex-girlfriend were arguing at about 9 p.m. Thursday, Feb. 16, when the dispute turned physical. Cruz allegedly grabbed the woman by the throat and attempted to choke her while she held a 1-year-old child.

Cruz is also accused of taking the woman's cellphone from her when she tried to use it to summon help, the sheriff's report said.
