Supervisor Colacino welcomed those in attendance followed by the gathering in the pledge of allegiance.

Present: Supervisor Colacino, Councilpersons; Westcott, Diamond, Nielsen and McIlwain, Atty Saracino and CEO Verkey.    
 
Absent: Highway Supt. Harder     

Minutes:  Motion made by Councilman Diamond, Seconded by Councilwoman Westcott to approve the minutes of  May 14th .  All voted aye.   
                                             
Reports of town officials: Moved by Councilman Nielsen, seconded by Councilman Diamond, to accept the following reports: Town Clerk, Code Office and Highway. All voted Aye.

Communications: Canal Trail Dedication – Oct. 3.

Public hearings:
7:30 p.m. Tax Levy Limit Local Law No. 1 of the Year 2013. Moved by Councilwoman Westcott, seconded by Councilman Nielsen, to close the regular meeting and open to a public hearing for the Local Law for the Tax levy Limit for the year 2013. All voted aye.

Clerk Allerton read the notice of Public Hearing. Supervisor Colacino asked for public
Comments: Todd Howard, stated that the Town has spent $172,000 on a landfill another $23,000 on 1303 North Main Street and now you want us “the taxpayer” to pay more for your pipe dreams. Taxes are already through the roof.  

7:35 p.m. Moved by Councilman Nielsen, seconded by Councilman Diamond, to close the public hearing and reopen to the regular meeting. All voted aye.

Moved by Councilwoman Westcott, seconded by Councilman Diamond, adopting a proposed Local Law of the Year 2013 to allow the Town of Arcadia to adopt a Budget for fiscal year 2014 that may result in a real property tax levy in excess of the “Tax Levy Limit” as defined by General Municipal Law section 3-c. All voted aye.

8 p.m. - Alex Quku – Special Authorization Use Permit. Moved by Councilwoman Westcott, seconded by Councilman Diamond, to close the regular meeting and open to a public hearing for a Special Authorization request by Alex Quku. All voted aye.

Town Clerk Allerton read the legal as published, the Town of Arcadia Planning Board recommendations, Wayne County Planning Board recommendations and noted that the Negative Declaration has been filed with the Town Clerk. Mr. Quku explained to the Town Board that he has purchased 1442 Welcher Road and would like to operate a Lawn and Garden Center at this location. Hearing no comments, Supervisor Colacino asked to close the Public Hearing.

8:05 p.m. Moved by Councilman Diamond, seconded by Councilman Nielsen, to close the public hearing and reopen to the regular meeting.  All voted aye.

Moved by Councilman Nielsen, seconded by Councilwoman Westcott, to authorize the Special Authorization for a Special Use Permit to operator a Lawn and Garden Center at 1442 Welcher Road. All voted aye.

Unfinished business: Arcadia Sustainable Energy Park. Mr. Rankin, Larson Engineering, discussed the NYSERDA Grants for solar. Supervisor Colacino stated that the Village of Newark and the Newark Central School will decide next week if they are interested in pursuing this NYSERDA Grant.

There were several questions regarding the “soft cost” fees. The municipality would be responsible for the cost of the meter and attorney fees. There is no upfront cost to Larson Engineers.

Supervisor Colacino stated that the Town of Arcadia will be moving forward on this NYSERDA Grant for Solar, even if the Village and School choose not to at this time.

Town of Arcadia Zoning Code – Update. Councilman Nielsen stated that he is reviewing the cost of completing this project. This will have to be budgeted for 2014.            
 
New business: Landfill Monitoring. Moved by Councilman Nielsen, seconded by Councilwoman Westcott to authorize KR Applin & Associates to use ALS Environmental Laboratory to perform the groundwater sampling and analysis at the Town’s closed landfill site. All voted aye.

Notice of Claim – Department of State. The General Municipal Law has been amended to permit notices of claim against public corporations to be served on the Secretary of State. The Secretary of State will then send a copy of the notice of claim to the public corporation. A certificate will be required to be filed with the Department of State designating the Secretary of State as their agent for service of notices of claims.

Moved by Councilman Nielsen, seconded by Councilwoman Westcott to adopt the alternative service of notice upon the Secretary of State to comply with the General Municipal Law Section 53.  All voted aye.

Assessor - Reappointment. Moved by Councilman Diamond, seconded by Councilwoman Westcott, to reappoint Lawrence G. Quinn, Sole Assessor for the Town of Arcadia and Village of Newark. This is a six-year appointment beginning Oct. 1, 2013 – Sept. 30, 2019. All voted aye.
Public Comments: Mr. Brian Donnelly asked the Town Board if the Town has received any more money from Mr. Allocco for the Landfill attorney and engineering fees?

Attorney Saracino stated that a letter has been sent to Mr. Allocco’s attorney this week.
Mr. Todd Howard asked Supervisor Colacino what 1303 North Main Street is going to cost the Town of Arcadia taxpayers.

Audit/payment of bills approved by the town board: General - 169-214 - $63,442.38; Highway - 126-147 - $90,530.11.

9:10 p.m. Councilman Diamond moved to adjourn  the meeting, seconded by Councilwoman Westcott. All voted aye.
